COURSE DESCRIPTION

The course examines key legal concepts and elements that govern business structures, business transactions and interactions between persons, companies or a combination of both.

GENERAL OBJECTIVES

  1. To apply the legal concepts learnt to support best practices within the student’s business environment

  2. To use these legal concepts to enhance their performance within the workforce.

COURSE LEARNING OUTCOMES

At the end of this course, students should be able to:

1. Identify and describe the main sources of law

2. Illustrate and discuss the hierarchy and the role of the Courts within Common Law legal system

3. Explain and discuss the elements of a legally enforceable contract and their importance

4. Remedies for Breach of Contract, Damages, Equitable Remedies

5. Explain the basic rule for Privity of Contract

6. Explain how tortuous liability arises as a civil wrong

7. Identify and explain when fault will not have to be proven under strict and vicarious liability and the elements required to establish the tort of negligence

8. Discuss the legislative framework governing contracts for sale and supply of goods and services and the ways in which a manufacturer may be liable in contract for defective goods.

9. Understand the nature of agency contracts, the formation and termination of agency contracts and the main duties of principal and agent.

10. Identify the different types of business organization, including advantages and disadvantages

11. Discuss the employers relationship with an employee and an independent contractor

12. Outline the tests applied by the courts to establish the extent of employer’s liabilities based on whether or not a person entrusted with tasks is an employee or an independent contractor.

13. Understand the development of e-commerce, the growth of the sale of goods and services by computer over the internet

14. Describe the functions and governance of the United Nations

15. Describe the Caribbean Community (CARICOM), the North American Free Trade Agreement (NAFTA), the World Trade organization (WTO) and explain how its dispute resolution procedure works
